Subscription and Billing * Access to the system is subject to the selected subscription plan. * Subscription fees are payable in advance unless otherwise agreed in writing. * Failure to pay subscription fees may result in suspension or termination of system access. * SMS charges, payment gateway charges, and other third-party service fees may be billed separately where applicable. 6. Acceptable Use You agree to use the system only for lawful property management purposes. You shall not: * Upload malicious software or attempt to compromise system security. * Access accounts belonging to other users. * Use the system for fraudulent or illegal activities. * Reverse engineer, copy, resell, or distribute the software without written permission from Havis Homes. 7. Data Ownership You retain ownership of the property, tenant, landlord, financial, and other business data you enter into the system. Havis Homes will not sell or disclose your data except where required by law or as necessary to provide the services. 8. Data Security Havis Homes employs reasonable security measures to protect your information. However, you are responsible for maintaining secure passwords and limiting access to authorized personnel within your organization. 9. System Availability While we strive to provide uninterrupted service, we do not guarantee continuous availability. Maintenance, upgrades, or unforeseen technical issues may occasionally result in temporary downtime. 10. Support Services Technical support is provided during our official business hours. Support includes assistance with system usage, troubleshooting, and guidance on available features. 11. Service Updates Havis Homes may update, improve, or modify system features at any time to enhance performance, security, or functionality. Major changes will be communicated where reasonably practicable. 12. Suspension or Termination Havis Homes reserves the right to suspend or terminate accounts that: * Violate these Terms and Conditions. * Engage in fraudulent, abusive, or illegal activities. * Fail to meet payment obligations. 13. Limitation of Liability Havis Homes shall not be liable for indirect, incidental, or consequential losses, including loss of profits, business interruption, or data resulting from misuse of the system, third-party failures, or circumstances beyond our reasonable control. 14. Confidentiality Both Havis Homes and the Property Manager agree to treat confidential business information obtained through the use of the system as private and not disclose it to unauthorized third parties. 15. Governing Law These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Kenya. 16. Amendments Havis Homes may revise these Terms and Conditions from time to time. Continued use of the system after any revisions constitutes acceptance of the updated Terms. 17.
