Tenancy Agreement

AGREED TERMS AND CONDITIONS OF TENANCY ARE AS HEREUNDER. 1. No subletting, transfer or parting with possession without a written consent of the landlord or the authorized agents. 2. If the tenant is allowed to terminate this tenancy earlier than the fixed period stated above, re-letting fees shall be payable to the land lord or the authorized agents by him/her at the rate of 60% of one month’s rent 3. The tenant shall repaint and repair any item broken or missing to the same status as it was at occupation of the premise I .e in the expiry or as sooner on termination of this tenancy. 4. The premise shall be used solely as a residential dwelling house only and not for any commercial activities. All rent are due and payable on 5th day of the mouth whether formally or not by DEPOSITING CASH ONLY to the bank account provided. CHEQUES SHOULD NOT BE DEPOSITED BUT SUBMITTED BY THE 1 DAY OF THE MONTH. 5. Only original cash deposit slips/official depositing confirmation text must be submitted to the management by the 5th of the month and an official receipt obtained Any rent collection done by the managing agent shall attract KSH 300/= Collection fee. Cheques presented after 5th shall attract10% penalty THAT shall run till the 20th of that month with a minimum of ksh 500/=for the rents below KSh 5000/=which shall be construed as addition rent owing. And Rent payment done after the 5Th day of the month shall attract a 10% late payment fee. 6. The tenant shall pay a House deposit equivalent to one month rent and a water deposit that will be determined by the management. The WATER deposit is refundable after due performance of tenancy obligation at the expiry or on termination of the tenancy. 7. Rent will be reviewed upward according to the market rate after expiry of the lease period. 8. Unless otherwise stated, the notice period to terminate this tenancy shall be one calendar month from either party. 9. IF the electricity, water and other charges [where applicable] are not paid as they fall due, the same shall be construed as rent owing and Distrainable with rent/water Deposit is not acceptable. 10. Deposit will not be refunded unless final accounts of water and electricity bill are provided and confirmed correctly on expiry or termination of the tenancy. 11. Bounced cheques shall be surcharged not less than ksh3000/= and construed as rent owing. 12. Rent and other payment construed as rent owing not paid within the due dates shall be recovered as rent under Cap 293 of the laws of Kenya and not withstanding any other legal action open to the land lord and agents thereof. 13. The tenant shall neither smoke nor use illegal drugs within the premise reconnect already disconnected water or power, open closed doors, break up locks or windows, quarrel with other resident. He/She shall as well not host persons of questionable characters and at the same time shall always play music to acceptable volume. 15. The main gate shall always be kept under key and lock the key must be surrendered to the caretaker at the tenancy. 16. The landlord/Agent shall not be held responsible whatsoever for any loss or damage to the tenant’s personal property and persons. NB- All vacation notice MUST be issued to either party in writing and must be done at least one month before the vacation date 17. PETS: No animal, fowl, fish, reptile, and/or pet of any kind shall be kept on or about the premises, for any amount of time, without obtaining the prior written consent and meeting the requirements of the OWNER. 18. NOISE: RESIDENT agrees not to cause or allow any noise or activity on the premises which might disturb the peace and quiet of another RESIDENT and/or neighbor. Said noise and/or activity shall be a breach of this agreement.
